Мария Калинина высказалась о создании ГИС «Антикартель»

Пре­зидент Рос­сии Вла­димир Пу­тин под­пи­сал за­кон о соз­да­нии ГИС "Ан­ти­кар­тель". Документ разработан Федеральной антимонопольной службой. Ее фун­кцио­нал поз­во­лит ана­лизи­ровать дан­ные Еди­ной ин­фор­ма­цион­ной сис­те­мы (ЕИС) в сфе­ре за­купок, ГИС "Тор­ги" и иную ин­фор­ма­цию в це­лях выяв­ле­ния рис­ков на­руше­ний ан­ти­моно­поль­но­го за­коно­датель­ства, в ав­то­мати­чес­ком ре­жиме с по­мощью эле­мен­тов ма­шин­но­го обу­чения.

Адвокат, партнер адвокатского бюро DS Law Маря Калинина полагает что создание ГИС «Антикартель» не повлияет ни на количество антиконкурентных соглашений, ни на процедуры закупок.

 «Антимонопольная служба длительное время пыталась лоббировать разработку этой системы, но получилось далеко не сразу. В апреле 2024 года ведомство даже опубликовало конкурс на разработку ГИС «Антикартель», на тот момент вообще не предусмотренную законодательством. Торги вызвали недоумение профильных специалистов. Контракт стоимостью 240 млн. рублей к созданию системы не привел и был расторгнут. Летом 2024 года ФАС провела новый конкурс и заключила контракт на 239,5 млн. рублей. Все эти действия ФАС России заслуживают отдельного внимания контрольных ведомств, так как не понятно, на каком основании были выделены бюджетные средства на не предусмотренную законом информационную систему. Сейчас мы видим, что ФАС с опозданием удалось легализовать сомнительные закупки – ГИС «Антикартель» наконец появилась в законе» комментирует Мария Калинина.

 По мнению Марии, создание ГИС «Антикартель» не повлияет ни на количество антиконкурентных соглашений, ни на процедуры закупок. Появится очередная система, без которой легко можно было обойтись и не тратить федеральный бюджет.  Для отслеживания картелей на рынке есть разработанные и успешно внедренные коммерческие технологии, которые позволяют установить признаки картельных соглашений на торгах.

2016

2017

The company's name becomes of a new meaning – Digital & Smart. The company is moving from the historical center of Moscow to the business center of Moscow City.
2018

Since then, the firm has maintained its position as the best law firm in this field. This year three partners of DS Law receive recognition from their colleagues in Best Lawyers for the first time.
2019
